In 2021, the Child-Parent Security Act (CPSA) went into effect, finally legalizing compensated gestational surrogacy in New York State. The law allows for both compensated (commercial) surrogacy and altruistic surrogacy, where the surrogate is not compensated for their services. 


Before this law, New York was one of the few states that explicitly banned compensated gestational surrogacy — forcing many families to seek surrogacy arrangements out of state.

The CPSA not only made surrogacy legal, but also:

 • Allows intended parents to establish legal parentage before the child is born


 • Includes a Surrogates’ Bill of Rights to protect those carrying the pregnancy


 • Provides a clearer, safer path to parenthood for LGBTQ+ individuals, those facing infertility, and single parents
